KEN
WINS FIRST TRIAL WITH UNANIMOUS JURY VERDICT
Jordan
v. Keller KCC 99-05028R
In his first trial Ken Chadwick convinced
a King County jury to return a very modest verdict in a case
involving admitted liability for an auto accident that happened
eight years ago.
This case came to the firm with a $35,000 default
judgment already entered against Ms. Keller and with a Plaintiff
vigorously opposing defense efforts to vacate the default. The firm
successfully moved to vacate and proceeded to defend the case.
Plaintiff claimed permanent injuries and the need
for lifelong chiropractic care from this 1996 rear end auto
accident. Plaintiff also claimed that the accident caused him to
gain weight, which he alleged caused him to suffer from meralgia
paresthetica, a painful neurological condition. Mr. Jordan asked the
jury to award him $50,000.
Ken was able to use Plaintiff’s medical records
and the testimony of a defense medical expert to show that Plaintiff’s
injuries had resolved no later then four months after the accident.
Ken then asked the jury to award Plaintiff Jordan medical specials
and wage loss not exceeding that four month period, as well as
commensurate general damages.
The jury awarded Plaintiff the exact amount of medical specials
and wage loss Ken asked them for, along with moderate general
damages, amounting to a total verdict of under $5,700. Given the
posture of this case upon its arrival and given Plaintiff’s
permanent injury claims, this modest jury verdict provided Ken with
a win in his first trial.
